CLUB WAIVER TERMS AND CONDITIONS 

You understand that exercise and physical activity including the use of equipment is potentially hazardous. You understand that participating in physical activity may result in injury and possibly even death and that you choose voluntarily to take part in these activities. This includes the use of any resistance, or cardio equipment, swimming pool, sauna, steam room and spas, and you are fully aware of the risks involved.

You understand that Village Gym maintain the highest possible standards of health and safety and before you enter the gym you will be asked to complete an online health declaration form to establish your current state of health before starting exercise. You understand that, depending on the answers you provide to the questions on the health declaration, you may need to seek medical advice before beginning any form of exercise and will not be granted access to Village Gym until a medical certificate is obtained. In addition to gym access being denied, if a medical certificate is required, you understand that my membership status will be temporary inactive and you will not be able to use the online members area.

You will assume responsibility for any minors under the age of 18 who accompany you whilst visiting Village Gym. You are responsible for advising Village Gym if your medical circumstances change during your membership term.

TANNING

Some Village Gyms have tanning and solarium facilities included as part of the membership package. You understand that you have read and accept the following terms and conditions relating to tanning and solarium use at Village Gym. Before using the tanning equipment, you agree that you have read and understand your skin type and agree to comply with Village Gym’s recommendations outlined below: 

Skin Type 1

People with very fair/sensitive skin and often with red/strawberry blond hair and freckles, pale blue, pale grey or pale green eyes. People who hardly or never tan.  Recommendations: You should not tan on a sunbed or outdoors. 

Skin Type 2

People with fairish skin who usually burn and sometimes tan. Tend to have light hair, blue or brown eyes.  Recommendations: The EU scientific committee on Customer Products states that people with skin types 1 and 2 should NOT proceed with UV tanning.

Skin Type 3

People with brownish white skins who tan fairly easily, they should respect the fact that they can still burn, especially without a base tan.  Recommendations: Although you tan easily you should respect the fact that you still burn.

Skin Type 4

People with dark skin who tan easily and hardly ever burn, but even so need to be careful that they don’t go through prolonged over-exposure.

Recommendations: You tan easily but should never have more than the full recommended session time.

There are skin types 5 & 6, 5 being naturally brown skin and 6 being brown/black skin. Generally, customers wishing to use sunbeds will fall into skin types 3 and 4.

Tanning should be undertaken with caution. To ensure you tan effectively and responsibly please read the following information before using the solaria:

  • If you have sensitive skin or no existing tan your first few sessions must be limited to 3 minutes, until your base tan has built up.
  • All tans must be built up gradually.
  • Prior to tanning, you must remove all cosmetics, perfumes, deodorants, jewellery & contact lenses.
  • Never use the tanning equipment without eye protection. This is available from leisure reception.
  • If any signs of redness remain from a previous tanning session, you must wait until this clears before your next session.
  • You must not attempt to adjust/tamper with any of the equipment.

You must NOT use the solarium if you:

  • Are under 18 years of age.
  • Have particularly sensitive skin.
  • Suffer ill-effects from allergies, cold-sores, epilepsy, dizziness or fainting, a heart condition, headaches or migraine, high blood pressure, hypertension, prickly heat or skin ulcers.
  • Are diabetic, hypersensitive to light, pregnant, taking any form of drug (prescribed or otherwise), using any ointment/lotion, antibiotic or tranquilliser or under medical supervision.
  • Have had hair bleaching, electrolysis or hot waxing in the past 24 hours.

If any of the above applies to you, please consult your doctor before using the solaria.

You declare that you have read and understood the advisory guidelines, and government recommendations not to exceed 20 tanning sessions per year and no more than one session per 24-hour period.

You declare to the best of your knowledge that the information you have provided is correct. You are over 18 years of age, are not affected by any of the above and know of no reason why you should not undertake a tanning session.

IMPORTANT COVID-19 HEALTH DECLARATION

Before entering Village Gym I can confirm that:

  • I do not have any COVID-19 symptoms
  • I have not received a positive test in the last seven days
  • I am not waiting on a Coronavirus test result
  • No member of my household has COVID-19 symptoms or is waiting on a test result
  • To the best of my knowledge I have not been in close contact with anyone who is exhibiting Coronavirus symptoms or has tested positive.
  • I also agree to maintain social distancing and to keep myself, fellow members and Village Gym staff safe by adhering to the safety advice and guidance given.

I understand that on each subsequent visit to a Village Gym I am also making the above Health Declaration.

This agreement will become binding upon both parties once you have checked the "Agree to Village Gym’s Club. Waiver" box and the "CONTINUE" button has been clicked.

USING THE CLUB

Village Hotels is the trading name of VUR Village Trading No 1 Limited, a company incorporated in England and Wales with registered number 418878. (‘Village’) In these terms and conditions (‘you’ and ‘your’) means you the member or guest using our gym or facilities, (‘we’, ‘us’ and ‘our’) means Village. To ensure the safety of all visitors, we require you to observe the following terms and conditions of use of Village gyms and use of the Village premises in which the gyms are located.

These General Terms and Conditions of Use apply to all Village gyms, and are in addition to all signs at Village gyms, in particular those relating to health and safety, and to the rules and regulations of individual Village gyms as they apply from time to time.

We reserve the right to make changes to these General Terms and Conditions and rules and regulations

If you do not understand any part of these General Terms and Conditions of Use, any signs displayed or the rules and regulations of individual Village gyms, please ask one of our team members to explain.

GENERAL USE

2.1 Prior to using any facilities at a Village gym you must complete a General Health Questionnaire. If there are some answers that indicate you have a medical condition, we may require a doctor’s note.

2.2 You must advise staff of any disability, including but not limited to blindness, deafness, heart condition and epilepsy, prior to using the facilities. This will help us in seeking to avoid accidents, injuries or misadventures to you and others.

2.3 While using the facilities you accept responsibility for your state of health and physical condition. You should not take part in any physical activity that you may not be fit for. If you suffer any unusual symptoms when using the gym facilities, you must immediately stop the activity and tell a member of staff.

2.4 You must not visit or use the facilities if you have an infectious disease, are displaying any symptoms of illness or are waiting on a test result in relation to an infectious disease.

2.5 If you or any guest or child that is with you suffers an accident or injury on the Village premises, it must be reported immediately to the most senior staff member on duty.

2.6 You must behave appropriately, respectfully and dress appropriately whilst on Village premises.

2.7 No pets are permitted on Village premises or its grounds, with the exception of registered working assistance dogs.

2.8 Smoking and use of vapours is prohibited in all areas on the Village premises.

2.9 No illegal gaming and betting is allowed on Village premises.

2.10 Shaving should be restricted to the vanity areas provided and is not permitted at any time in the shower, steam room, sauna or any other part of the gym.

2.11 All facilities may not be available at all gyms.

2.12 It may be necessary for us to close or withdraw all or any part of the gym facilities at any time for repair, maintenance, alteration or for safety reasons.

2.13 Cleaning materials are provided and members must ensure equipment is cleaned prior to and following use. Regular hand washing and use of the provided hand sanitiser is encouraged.

STUDIO ACTIVITIES

3.1 You must wear appropriate clothing and footwear at all times.

3.2 For your health and safety you must warm-up before taking part in any classes. If you arrive after the warm-up you may be excluded from participating for safety reasons.

3.3 Drinks may only be taken into the aerobics studio in a plastic re-sealable container

FITNESS STUDIO

4.1. In the interest of safety, no person under the age of 14 years will be admitted to the gym on their own (except during designated, supervised sessions). 14 - 15 year olds may only be admitted to the gym providing their parent or guardian is in the club.

4.2 All equipment has been designed and tested to be safe with the correct use. You must ensure for your own safety that you receive full instructions before using such equipment.

4.3 You must obtain prior permission to use the studio for a non-timetabled class.

4.4 You must only attend a class on which you have pre-booked in advance or on the day.

LEISURE POOL AREA

5.1 You must shower on entering the pool area, especially before and after using the sauna or steam room, and always shower immediately before entering the spa pool.

5.2 You must read and observe the notices displayed in the pool area.

5.3 You must at all times follow the rules and guidelines displayed, and any other instructions given by Village staff, regarding the use of the pool, spa, sauna and steam room.

5.4 For safe spa bathing, visits are limited to a maximum of 15 minutes.

5.5 No child under the age of 14 years is allowed in the pool area without the supervision of a parent or guardian aged 18 or over. The parent or guardian shall ensure that the child is fully aware of and adheres to these General Terms and Conditions of Use and to any gym specific rules and regulations. 14 - 15 year olds may only be admitted to the pool area providing their parent or guardian is in the club.

5.6 Children not yet toilet-trained must wear an appropriate swim nappy.

5.7 Children must vacate the pool immediately at the end of the designated children’s swimming time. Children’s swimming times may vary slightly from gym to gym - please check published opening times displayed in the gym or on our website.

5.8 You must not enter the pool while under the influence of alcohol or after a heavy meal.

5.9 A poolside telephone or alarm is provided in case of emergency.

5.10 Mobile Phones and any other recording devices are strictly prohibited in the Leisure Pool Area.

SPLASH N' SWIM

Kids Swim times are outlined on your club page of our website. Splash n' Swim sessions are available 3pm-5pm Saturday and Sunday, subject to maximum capacity levels. Should the pool reach maximum capacity, no further guests will be permitted entry. 

A parent or guardian must be on poolside throughout. 

Available to Village Gym members and hotel guests only.

TANNING FACILITIES

8.1 Sunshower(s) and sunbeds are available on a queuing basis.

8.2 You must read the health and safety guidelines relating to safe tanning, available from the Village gym reception, before using the tanning facilities.

8.3 Appropriate goggles must be worn at all times in a UVA/UVB environment.

8.4 Tanning facilities are not available to persons under the age of 18 years, in accordance with current legislation.

PHOTOGRAPHY AND VIDEOS

9.1 You must not take photographs or videos of any children under the age of 18.

9.2 You must not take photographs or videos of any other members without their express consent. You must get this consent before photographing or videoing any other member.

9.3 You must not take photographs or videos in a changing area, pool, sauna, steam room, spa or toilet area.

9.4 We may ask you to stop taking photographs or videos and delete them as appropriate.

9.5 Subject to the provisions set out above you are permitted to take photographs or videos of yourself for your own personal use only.

SOCIAL MEDIA

10.1 We operate a safe environment for our staff and guests. As part of that safe environment we ask all guests to use social media in an appropriate manner, having regard to other individual’s privacy.

10.2 Any use of social media identifying our staff or our guests or revealing their personal details will be taken as a serious breach of these terms and conditions and may result in your membership being terminated.

TERMINATION/SUSPENSION

11.1 We reserve the right to terminate membership for any of the following:

11.1.1 breach of rules and regulations;

11.1.2 serious breach of these General Terms and Conditions of Use;

11.1.3 conduct which, in our reasonable opinion, is damaging to the character or interest of the Village gym, or is offensive to other members or staff, hazardous to the health and safety of other members or staff or of significant impediment to the enjoyment of other members.

11.2 We retain absolute discretion to reject any application or renewal of membership without giving any reason for doing so.

11.3 Membership of the gym may be suspended by us if there are any irregularities regarding payments. We reserve the right to appoint a third party to recover outstanding membership fees. Access to the gym may at our discretion be denied until these issues have been resolved. If we think it is appropriate, acting reasonably and at its own discretion, the membership will be terminated.

LIABILITY

12.1 We do not accept liability for any loss or damage to your property that may happen whilst on Village premises, unless such loss or damage is caused by our negligence.

12.2 Nothing in these General Terms and Conditions of Use, or the rules and regulations of individual Village gyms, is intended to limit or exclude Village’s liability for death or personal injury caused by its negligence, or any liability for fraud.

12.3 Nothing in these General Terms and Conditions of Use, or the rules and regulations of individual Village gyms, is intended to limit or exclude any rights that members have as consumers.

12.4 We are not responsible for any harm that you suffer as a consequence of using Village gyms and their facilities, unless such harm is caused by our negligence.

DATA PROTECTION

13.1 We agree to comply with all relevant Data Protection Legislation which for the purpose of this Agreement shall mean the UK Data Protection Legislation and any other European Union legislation including the General Data Protection Regulation 2018 relating to personal data and all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of personal data (including, without limitation, the privacy of electronic communications)

13.2 We hold any information that you provide to us in accordance with our privacy policy on our website.

GOVERNING LAW

These terms and conditions and any disputes shall be governed by English Law and the parties submit to the courts of England and Wales.


15.7 On every visit to a Village Gym you will effectively be making the above Health Declaration.

CLASS BOOKING

ADVANCE BOOKINGS

You may book any bookable facilities up to 7 days in advance online via your online member access area and you may have a maximum of 14 classes pre-booked at any given time for those with standard booking right; for those with advance booking rights, you may have a maximum of 20 classes pre-booked.

All booked facilities/activities will be automatically checked in when swiping into the Club. This must happen prior to the activity starting otherwise your place maybe taken by another member.

Any facilities or classes can be cancelled a minimum 4 hours before the start time and will incur no penalties. Any classes that are cancelled after the 4 hour cut off period cannot be cancelled online. In the event of not cancelling 4 hours prior to the start or a no show will incur a penalty strike. Three penalty strikes accumulated in a 30 day period will result in a suspension of booking privileges for a 14 day period. To cancel a class after the 4 hour cut off period has passed can only be done by contacting the Club and requesting to cancel. No penalty will be applied if the space is filled by another member. Booking penalties can be appealed by contacting the Club Manager.

LOCKER HIRE

The use of Lockers is entirely at your own risk.

Lockers are made available subject to availability. Village does not undertake that use of a locker will guarantee that no theft of or damage to your property will occur. We will not accept any liability in relation to any use of the locker (including but not limited to any theft from the locker).

Lockers can be used by purchasing a £5 locker band from Leisure reception. Locker hire is not currently available.  

Lockers may only be used for the purposes of keeping gym kit, toiletries, and the clothing that you were wearing when you came to a Club. The keeping of any other items in a locker is prohibited. If Village has reasonable grounds to suspect that a locker is being used in breach of this Rule, Village reserves the right to open the locker in question (by force if necessary) and remove any offending items. Your belongings, so removed, will be available for collection from the relevant Club’s Reception for a period of thirty days. If you do not collect your belongings within thirty days, your belongings may be donated to charity. You may not allow other members or guests use your locker to store their belongings.

If you rent a designated private locker (if available), and if the rental fees in respect of that locker remain unpaid for more than two weeks after the date due for payment, Village reserves the right to open the locker (by force if necessary) and remove your belongings. Your belongings, so removed, will be available for collection from the relevant Club’s reception for a period of thirty days upon payment by you of the unpaid fees along with the reasonable prevailing administration charge. If you do not collect your belongings within thirty days, your belongings may be donated to charity.

Village reserves the right to alter the fee charged for private lockers, reviewing ahead of the renewal of your rental fee. Should you cancel your membership at the club within your rental period, no refund will be provided for remaining months. Freezing your membership will not alter the end day of your locker rental agreement. Village reserves the right to end the hire agreement by giving one months’ notice.

Village reserves the right to amend and vary these terms of use as and when appropriate. Offer not currently available at Village Gym Bournemouth or Chester St Davids.

CAR PARKING

We now charge for parking at the majority of Village Hotel sites. However, members have up to 4 hours free parking up on every gym visit.

Should any member decide to be at the hotel or gym over a 4 hour period, please advise the team at the hotel reception and inform them of the car registration. For further details, click here.

WELLNESS REVOLUTION-ON DEMAND FITNESS

Membership to the Village Wellness Revolution is free to all adults over the age of 16 who live in a country that permits them to sign up.

Village Management may deny membership to the Wellness Revolution at its sole discretion and without written notice.

Only individuals are eligible to become a Member and each individual may maintain only one Membership. Accounts are not transferable or assignable.

Members are responsible for reading and understanding these terms and conditions about the Village Wellness Revolution. If a Member has any question or queries about the Wellness Revolution they should contact their local club.

Village may terminate membership of the Wellness Revolution at any time.

Changes to personal details may be made online via the members area.

 

24/7 GYM ACCESS

24/7 access is available for select gym membership types only and is operating at Village Gym Basingstoke, Bristol and Portsmouth. 

To find out if your local club is offering 24/7 Gym access please visit the relevant club page on this website and look at the Opening Hours.

24/7 access is by valid membership card – entry will be refused if you cannot present your membership card.

Hotel guests may use the club facilities during set times, and use for hotel guests excludes 24/7 access for safety reasons.

Minimum entry for 24/7 gym access is 18 years. For health and safety reasons, members under the age of 18 can attend the gym only during the peak hours shown for the club. 

24/7 access does not include access to changing rooms, studios or wet areas due to health and safety considerations.

Towels will not be available outside of normal operating hours.

CCTV is in operation and emergency alarms are installed in the gym should you feel unwell or need emergency help.

Fitness Coaches will not be onsite other than at normal operating hours

Management reserve the right to withdraw 24/7 access at any time due to the need for essential maintenance work, if adequate supervision cannot be arranged or if they have health and safety concerns.

Please note whilst Black Card provides multi-club access you can only get 24/7 access at your home club.

PERSONAL TRAINING

These terms and conditions govern the provision by Village to you of personal training sessions.

These terms and conditions are in addition to the Membership Terms applicable to your membership (Membership) and the Terms of Use applicable to your Membership (Existing Terms).

These terms and conditions apply from the date of the Booking Acceptance (as defined below).

We reserve the right to amend and or change these terms and conditions in accordance with the Membership Terms.
If these terms and conditions conflict with the Existing Terms, these terms and conditions will prevail.

BOOKING AND PAYMENT

The number of personal training sessions purchased (which may be a single session or a block of sessions, as described below) and the price for the session(s) is as set out in the booking confirmation you signed when you booked the relevant personal training session(s) at your Home Gym reception or as set out in the online booking confirmation for personal training sessions accepted by you in any case where you book personal training sessions online via the Village website or Village app (Booking Acceptance).

Your session(s) will be on such days and at such times as may be set out in the Booking Acceptance or as may be otherwise agreed between us or at such other times as may be determined under these terms and conditions.

Our obligation to provide your personal training session(s) will automatically end at the same time as your Village gym membership ends in accordance with the Existing Terms.

Personal Training Sessions can only take place at your Home Club (as defined in the Membership Terms).

Payment Packs and Block Bookings of Personal Training Sessions

All payments for Personal Training Sessions must be made to Village at the gym reception or online or via the Village app and not directly to your chosen trainer. Village is responsible for paying personal trainers who provide personal training at Village gyms.

The price for your Personal Training Session(s) is as set out in the Booking Acceptance.

With the exception of the 30 minute package, sessions are approximately one hour in duration unless otherwise agreed with your trainer.

All personal training packs/block bookings are subject to the following period of expiry. Personal Training Sessions which have not been used within the relevant period will not be available and no refunds will be made in relation to such sessions. Where a single session has been booked, it must be used within 1 month from the date of purchase.

30 minute and 1 hour packages = 1 month from date of purchase
4 x 1 hour packages = 2 months from date of purchase
10 x 1 hour packages = 4 months from date of purchase.
15 x 1 hour packages = 6 months from date of purchase (only available at selected clubs)

MANAGEMENT OF PERSONAL TRAINING SESSIONS

Late Arrival

If your trainer is less than 10 minutes late for your session he/she will be required to still complete the full session..

If your trainer is more than 10 minutes late for your session you will receive one free session, arranged at a mutually convenient time for you and your trainer.

If you are more than 20 minutes late for a session, that session may be cancelled and you will be charged for the full session.

Personal Trainers

If you would like to change trainers for any reason, please contact the club manager and he/she will be happy to assist you with the transition. You accept that we may not always be able to accommodate requests to change trainers as it will depend on the availability of our trainers

It is important for you to notify us of any medical conditions that may affect your ability to take part in physical training or which may be made worse by physical training. Should you experience any pain, discomfort or injury during any of your sessions, please let your trainer know immediately. We may decide at any time that medical conditions you tell us about or medical conditions which are or become apparent during sessions or pain, discomfort or injury suffered by you during sessions mean it is not safe for you to start or continue with personal training sessions or with particular exercises. If we make that decision we will tell you and may end your personal training sessions or change the content of the sessions.

Prior to or during the course of your training, health concerns may arise that may require further input from your doctor, physiotherapist, or other healthcare professions. If such concerns arise you should consult an appropriate health care professional before continuing your training sessions.

Please be aware that whilst our trainers are experienced in their fields they are not health care professionals and cannot diagnose and/or prescribe treatment for any form of injury, disease, or any other medical problem.

If your personal trainer is on holiday or otherwise absent (as opposed to being late for a scheduled session), please contact the club manager and you will be allocated a temporary trainer for the duration of any absence we will allocate a temporary trainer to you for the duration of the absence. Sessions must still be used within your normal validity period unless otherwise agreed.

Should your trainer leave our employment the club manager will allocate you another trainer and will supply them with your complete training history. Refunds will not be provided under these circumstances.

If for any reason we are unable to provide a personal trainer for any session(s) you have booked within the relevant period or we decide that it would be unsafe for you to continue with a personal training session or sessions because of information we have about your medical condition we will not charge you for that session or those sessions and will refund any payment already made by you for that session or those sessions.

CANCELLATION

Cancellation of individual sessions by you

If you need to cancel a session that you have booked (as opposed to cancelling your purchase of a block of personal training sessions), you must give us a minimum of 24 hours’ notice of cancellation. Failure to do so will result in your session being charged for in full at the session rate set out in the Booking Acceptance. If you tell us you are cancelling a session more than 24 hours beforehand, you will be permitted to re-book this session at another time and will not be charged.

Cancellation by Village

If for any reason we need to cancel your session within 24 hours of its start time, your next session will be delivered free of charge or if you have no further sessions booked, the price for the cancelled session will be refunded to you.

Cancellation of entire bookings via the Village website or app by you

If you have purchased your personal training session(s) online (via the Village website or app), you have 10 days from the date of the purchase to cancel the purchase by telling us by telephone or by emailing us within that 10 day period.
If you cancel within the 10 day period, we will not be required to provide the session(s) and you will not be required to pay for it or them. Where you cancel the purchase, any sessions taken before cancellation will be charged at the price set out in the Booking Acceptance.

If you cancel your purchase of personal training sessions or some or all of the personal training sessions, doing so will not end your Village membership, which will carry on in accordance with the Existing Terms.

Refunds

If you are unable to complete your sessions due to medical reasons a refund may be available for any remaining sessions.. You will need to provide us with evidence explaining that you are unable to continue for medical reasons including a time frame for these restrictions prior to a refund being given (i.e. a doctors letter).
Save as set out in these terms and conditions, refunds cannot be provided under any other circumstances.

PERSONAL TRAINING: PAYMENTS VIA DIRECT DEBIT

These provisions apply where you [have purchased a block of personal training sessions and you] choose to pay for personal training sessions by direct debit.

All payments for personal training sessions via direct debit must be paid on the first working day of the month (via direct debit) in line with your membership fee in respect of the sessions scheduled for that month. The first such payment will be due on the first day of the next calendar month after the date of the Booking Acceptance. [Initial sessions may be purchased at the gym reception prior to commencement.

Additional sessions on top of your DD allocation can also be purchased via the gym reception each month if required.
[A minimum term of 3 months is required when using personal training by DD.

All personal training sessions paid for via direct debit will expire and be deemed used (if not actually used) at the end of the calendar month in which the direct debit payment for that session is made. No refunds will be given for any sessions not used in the same month as the related direct debit payment. No sessions paid for by direct debit will be carried over to future months except in exceptional circumstances and with authorisation from the Manager of your Home Gym.

Should your account fail into arrears at any stage (because a direct debit is declined by your bank), personal training sessions will cease until the outstanding balance is paid in full. Any related relevant period for which personal training sessions have been purchased shall be suspended from the date your account falls into arrears and shall resume when the account has been paid in full.

If you wish to stop paying for personal training sessions via direct debit, you must notify us in writing no later than the 20th day of the calendar month prior to the month in which the direct debit is to be collected. If we receive that notification no later than that 20th day, we will not collect any further direct debits from you in relation to personal training sessions.
